Terms of use :: P-Edge media

These terms of use (hereinafter referred to as: Conditions) apply to the use of the apps from P-Edge media (hereinafter referred to as: Apps). You can download, save or print these Terms.

By accessing or using the Apps, you agree to these terms.

1. General

1.1 The Apps are offered by P-Edge media, Chamber of Commerce number 34142483 (hereinafter referred to as: P-Edge media).

1.2 P-Edge media can adjust these Terms and Conditions in view of new developments. The most recent version can be found on the website: https://p-edge.nl/eng/about/terms-use.

1.3 The Apps and their content are for general information and/or entertainment purposes only and are not intended as advice.

2. Definitions

Apps: Applications developed by P-Edge media and made available to users for use on a mobile phone or other device running an Apple operating system and any updates made from time to time and any other software or documentation that facilitates the use of enable these applications.

Content: All data (including images and sounds), services, software, files, ideas or other information accessible through the Apps.

Equipment: The (peripheral) equipment, including a smartphone, tablet or PC with which you use the Apps, including the associated operating system.

3. Using the apps

3.1 You can use the Apps without an account or login details.

3.2 In order to use the Apps, you must download the Apps from Apple's App Store. Downloading from another source, such as a jailbreak store, is not allowed.

3.3 It is important to use the latest version of the Apps. If you are not using the latest version of the Apps, the Apps may not function properly or not at all.

4. Handling Apps with care

4.1 In order to use the Apps properly and safely, you must use the most current operating system from Apple that your device supports. Otherwise, the Apps may not work or not work properly.

4.2 To prevent misuse and/or malfunctions and/or other problems, you must ensure that your Equipment and connections are sufficiently secure.

5. Purchase

5.1 For Apps, you pay the price displayed in Apple's App Store at the time of purchase.

5.2 The price of all Apps, including free apps, may be adjusted by P-Edge media at any time.

5.3 You bear the costs of the purchase and use of the Equipment and connections (mobile and/or wireless internet) that are necessary for the use of the services via the App.

5.4 An account (Apple ID) from Apple is required when purchasing the Apps or making In-App Purchases. The General Terms and Conditions of Apple Media Services apply to this.

5.5 When Apps are removed from the device, you can download them again from Apple's App Store. If you have previously paid for an app, you will not be charged again. You can restore any valid In-App Purchases in the menu of the relevant app after it has been reinstalled.

6. Security Precautions

6.1 You are responsible for the use of the Apps. You must follow all directions and regulations of P-Edge media provided in connection with the use of the Apps.

6.2 You may not use the App in an unauthorized or careless manner. P-Edge media is entitled to block access to the App in the event of abuse or unauthorized use of the App, among other things.

6.3 If you think that you can no longer safely use the Apps, remove them from the device and download them again from Apple's App Store.

7. Liability

7.1 P-Edge media makes every effort to make the Apps available to you. Despite constant attention, care and warranties, P-Edge media cannot guarantee that the Apps will function without errors and without interruption. P-Edge media does not accept any liability for the consequences of any inaccuracies in the data that is accessed via the Apps.

7.2 P-Edge media can stop offering the App or change the Content at any time.

7.3 P-Edge media is not liable for any damage or costs incurred by you or third parties, for whatever reason, as a result of the use or inability to use the Apps, unless the damage in question is caused by intent or deliberate recklessness from P-Edge media.

7.4 The Apps may contain advertisements or links to external internet pages. P-Edge media is not liable for the use, content or functioning of these external internet pages and does not accept any liability for this. P-Edge media is not responsible for the processing of your personal or other data on these external internet pages.

8. License and Intellectual Property

8.1 The Content of the Apps, the data, images, sounds, texts and combinations thereof and other software contained therein are protected by copyright and trademark rights. These rights belong to P-Edge media. You are not allowed to copy or publish, exploit or otherwise use any part of the Apps or this website without prior permission from P-Edge media.

8.2 P-Edge media hereby grants you a non-exclusive, royalty-free and revocable license to use the App in accordance with these Terms.

9.Privacy

9.1 The use of the Apps is subject to the privacy policy, in which you can read how P-Edge media handles the processing of your personal and other data. You can find this policy at https://p-edge.nl/eng/about/privacy-policy.

10. Terminate and Deactivate Apps

10.1 P-Edge media may terminate the use of the Apps at any time. Upon termination, the rights and licenses granted to you in these Terms will terminate.

10.2 You can terminate the use of the Apps yourself by removing the Apps from your mobile device.

10.3 You must terminate current subscriptions yourself via Apple's Apple ID account. P-Edge media cannot cancel subscriptions for you.

11. Applicable Law

11.1 These Conditions are exclusively subject to Dutch law. All disputes arising in connection with the Apps and/or these Terms, including disputes about the existence and validity thereof, will be settled by the Rechtbank Noord-Nederland.

12. Other Provisions

12.1 If these Terms and Conditions are or become partially invalid, the parties will remain bound by the remaining part. The parties will replace the invalid part with stipulations that are valid and the legal consequences of which, in view of the content and purport of these Conditions, correspond as much as possible to those of the invalid part.

12.3 You agree that Apple may be a third party beneficiary to the Terms and that Apple has the right to enforce the provisions of the Terms on its own behalf.
